1)There is no rule that you need to mate in order to win.
There are other ways to win like opponent resign or opponent lose on time.

2)In most cases Rybka can mate.
It is simply confused by too many mating possibilities but with KQ vs K it can
mate based on my experience(it does not take the fastest way to do it but it
does mate.
