As with anything these days, from "single click order" of Amazon and up, there is a patent application (still in pending state) on the novelty aspects of the algorithm, as well as the copyright on the source code. That's how it has to be done these days for ones own protection. The non-commercial use of either is free (see license.txt). I would imagine if Kodak wanted to put the algorithm into its digital camera some day, they would need a commercial license (assuming patent is granted by then and their variant uses the patented aspects). The educational & research use, even with a commercial aspect (e.g. a college charging for a CS course and using the code or preprints for teaching), is also free. I am not an attorney and haven't dwelt on this topic beyond the absolute minimum I couldn't avoid, so that's roughly my understanding of the IP status and the licensing.
