He clearly states that the game tree takes on this as the PE increases its error rate!!!! Thus, this is exactly what I was talking about. However, he states in his conclusions that pathology doesn't seem to show up in chess or checkers. However, he wrote the paper in 1979 when the search depth of the period was very small compared to today!!!!! Thus, I suggest he revisit the thought. This also could explain why Marion Tinsley blew everybody and all computers away at checkers and nobody understood why or how. Chinook became so good it could beat all but Tinsley. Thus, Tinsley's understanding (PE) of the game was far supperior. Thus, maybe, only in that context can this type of phenomena be noticed -- your opponent must have a better understanding/PE than you do. Thanks for the response and the reference!!!!
