I think you said it pretty well.

A clone doesn't mean stolen and in this case, can also be legal.

Perhaps a different word than clone should be used by the CCT TD -- but I do not
see this as a moderator issue at all - merely coincidence that the CCT 8 TD is
also a moderator.

No matter what you call Toga, copy, clone etc -- it is based on Fruit. The TD
has stated he does want not copies or clones in the tournament. I think that is
within in his rights as the organzier of the tournament. I think that's a good
rule- despite the fact that Toga is so strong and from my tournaments - is
second to no other program except possibly Rybka. I would favor an exception to
this rule in this case -- but I would not fault the TD for standing firm on this
issue.

The problem becomes when you start breaking your own rules - where do you draw
the line. Another option is to redine the tournament rules, but it's far too
late now to do this for CCT 8.

So in closing - Toga is an incredibly strong program and is most likely the
strongest free engine available (that's bug free) but it's acopy of Fruit
(atleast in part) and if you allow this copy to perform - what to stop somebody
like me - with Bob's permission and blessing (supposing for moment that was
granted) . make copy of Crafty and enter in the tournament. I would have the
same argument as the author of Toga -- and then people would quickly realzie
anybody could this as long as they obtained the original author's permission and
it was properly documented. In theory we could see 32 Crafty's all modified to
soem extent next year (as long as Bob agreed -- which is seriously doubtful).

I have to agree with the CCT 8 TD on this one, desptte the fact that I love Toga
and would personally like to see it in the tournament
