I then returned the bad disk and received a new one without any problem. If Gambit-SOFT states that they take the risk they will (or must in your case) do so. But apart from their statement I'm a little bit curious about what happens if every customer states that their shipment have never arrived (don't get me wrong - I'm _not_ saying that you do this!)? What does the law say? Probably that the dealer takes the risk until the item have arrived!? For your personal problem with Bert: I suppose that he will answer you by e-mail and not in this forum. Personally I think Gambit-SOFT is the greatest [Sorry Steven, I haven't bought anything from ICD yet...]!
