At the ACM events, it is _required_ that you show up with source code handy, so that the tournament committee can verify that your program is unique. This was used many years ago to catch one particular cheater that claimed to have a program, and he had source, but it was not the source that he used... he had somehow stolen a commercial engine and was using that to actually play the moves. Levy could provide more info if needed. Without an explicit rule against clones, and a requirement that source be available for inspection, it would be nearly impossible to protect against such things...
