That is not following the rules either (but of course the servers can implement the rules in a way which is convenient for them, even if they differ from regular tournament practice). If the position is to be repeated for the third time after you making your move, the correct procedure to claim the draw is: 1. Write down your move in your score sheet. 2. Claim the draw (without making the move over the board!). If the claim is invalid, you are forced to make the move you have written down, and in any case it is part of the game. Claiming the draw is optional, but by making the move over the board you are implicitly choosing to not claim the draw, leaving that choice for your opponent. If the position has just repeated three times and it is your turn to move, you can claim the draw. The general policy is that only the player who has the move on the board can claim the draw. José.
