Tough question. :-)
What does your average lawyer think about the weight of Rook access to e5?
And would their opinion matter?

Even engine programmers don't care if it's 5 or 10, because it doesn't matter.
Likewise, even lawyers don't care if OPK recipes or cracks are on the left or
right side of some imaginary thin line. Unless they're told to make the line
real and thick, by someone who feels his business is being threatened. That
won't happen regarding Chessmaster, but nevertheless the ongoing battle between
the recording industry and the music sharing crowd is something worth watching
from the sideline.

The bottom line is that my views on legality are none and void.

My views on copy protection in general are simple: it annoys developpers and
users, but management always decides in favor. IMHO a cool box, a nice manual,
the feeling of the real thing, and a low price should be enough to preempt
large scale piracy of software, or any mediaware.
But that's just MHO, and I'd welcome any decent research on the subject. :-)
